First and foremost, make sure that you always seek medical attention right after the injury.  This makes sure that the injury is documented and verified by an independent third party and will link the injury to the actual accident, and makes sure that it’s not something that you made up after the fact.

After this, you will have to file your compensation claim.  This can be done with the insurance company, or if your injury has come through your workplace, it can be done through your employer.  In most cases, after this it will not be necessary to file a lawsuit.  The insurance company will make you an offer soon after if you have the injury properly documented and verified.  If you think the offer is fair, you can take it on the spot, but most often you will need to participate in some form of negotiations.  Come up with what you think is a reasonable amount for your claim and have it supported by evidence.  Negotiations are always a bit of a back and forth, but if you are persistent and use some good negotiation tactics, you should be able to get around the right amount that fully compensates you for your injury.
